JAL Wagyu Souvenir Service (Shopify Shop) Terms of Use

These "JAL Wagyu Souvenir Service (Shopify Shop) Terms of Use" (hereinafter referred to as "these Terms") set forth the conditions for using the "JAL Wagyu Souvenir Service (Shopify Shop)" (hereinafter referred to as "this Service") provided by Japan Airlines Co., Ltd. (hereinafter referred to as "JAL").

For matters not stipulated in these Terms, the provisions of the "JAL Homepage Site Terms of Use" will apply.

Users are deemed to have agreed to all the terms of both these Terms and the "JAL Homepage Site Terms of Use" before using this Service.


Article 1 (Application and Revision)

1. These Terms define the rights and obligations between JAL and users (as defined in Article 2) concerning the use of this Service and apply to all relationships between JAL and users regarding the use of this Service.

2. This Service is provided within the "JAL Wagyu Souvenir Service (Shopify Shop)" (hereinafter referred to as "this EC Shop") operated by JAL.


Article 2 (Definitions)

The following terms used in these Terms shall have the meanings defined below:

(1) "Service" means a service that allows users departing from Japan (Tokyo International Airport or Narita International Airport) and entering the United States or the Republic of Singapore to bring fresh wagyu beef back as carry-on luggage, with JAL acting as an agent for the necessary export quarantine procedures, etc. (including any modified services if the service name or contents are changed regardless of the reason). This is not cross-border e-commerce and does not involve direct delivery overseas.

(2) "User" means an individual who meets the conditions in Article 3, paragraph 2, and receives the Service based on these Terms.

(3) "Parties" means individuals or legal entities that manufacture, procure, and sell the product (see Article 5) in this Service.


Article 3 (Use of the Service)

1. Users may use this Service within the scope of the purpose of these Terms and as long as they do not violate these Terms.

2. Users must simultaneously meet the following conditions:

(1) Individuals departing from Japan (Tokyo International Airport or Narita International Airport) and entering the United States or the Republic of Singapore on JAL flights. Note that individuals using Tokyo International Airport or Narita International Airport for international connections cannot make purchases. Those who transfer via the United States or the Republic of Singapore also cannot make purchases. Individuals using flights operated by other airlines, including JAL code-share flights, cannot make purchases. Domestic consumption within Japan is not allowed.

a) Bringing meat to the United States from Japan is limited to 22.6kg (50lbs) per person.

b) Bringing meat to the Republic of Singapore from Japan is limited to 5kg (11lbs) per person.

* Note: Provisions related to a domestic Japanese address, JMB details, and more are removed.


Article 4 (Contracting Parties)

1. The products in this Service (see Article 5) are manufactured, procured, and sold by the following parties:

(1) Producers: Wagyu producers in various production regions (regions differ depending on the product).

(2) Manufacturers: Businesses operating export meat handling facilities approved by the Ministry of Health, Labour and Welfare of Japan.

(3) Procurer: JA Zennoh Meat Foods Corporation (Minato-ku, Tokyo).

(4) Seller: Tsuchiya Co., Ltd. (Yokoshibahikari-machi, Sammu-gun, Chiba Prefecture).

2. This Service provides a platform for sellers to sell products to users (provides a place for the convenience of information gathering and sales transactions), and the sales contract for the products is concluded between the user and the seller. Therefore, users acknowledge that they are applying to purchase products from the sellers via this Service in compliance with these Terms, and JAL is not a party to the sales contract.

3. If products sold through this Service do not conform to the sales contract contents regarding type, quality, or quantity, the seller is responsible, and the seller will provide a refund at the seller's responsibility and expense. However, the refund will be carried out through the system of this EC shop.

4. Users shall not transfer, assign, set security for, or otherwise dispose of contractual status or rights or obligations arising under the contract with respect to third parties.

5. Unless there is intentional or gross negligence on the part of JAL, JAL shall not be responsible for any contractual non-conformity responsibility, quality warranty responsibility, damage compensation responsibility, or any other responsibilities for products sold via this Service.


Article 5 (Products)

1. The products sold under this Service (regions of origin differ depending on the product) are vacuum-packed and frozen under careful quality control, processed at export meat handling facilities approved by the Ministry of Health, Labour and Welfare of Japan.

2. The consumption period is within 96 hours in chilled conditions from packaging. Please check the consumption period displayed on the packaging.

3. Cancellations due to customer convenience are accepted up to 48 hours before the scheduled departure time.

4. These products are not duty-free.


Article 6 (Purchase)

1. To use this Service, users purchase products through this EC shop.

2. Users must agree to these Terms to use this Service.

3. Users need to provide the flight number, date, and airport of use they plan to board. If there is a change in the planned flight after purchase, users must notify JAL through the inquiry window of this EC shop at least 48 hours before the scheduled departure time.


Article 7 (Payment)

1. Users shall perform payment obligations to sellers based on the sales contract concluded with the seller.

2. Payments from users to sellers, including the sales price and consumption tax, shall be made through this EC shop, and sellers shall not make separate claims to users.

3. Although the sales contract for the products is concluded between the user and the seller, since JAL receives the payment from users to sellers through this EC shop once on their behalf, the receipt will be issued in JAL's name. Users acknowledge that the sales contract for the products is between the user and the seller, but the receipt will include JAL's name as the operator of this EC shop.


Article 8 (Delivery)

1. Products will be delivered to the JAL ABC counter (departure lobby) at Tokyo International Airport or Narita International Airport, not to the billing address provided at the time of purchase.

2. Domestic delivery in Japan is the responsibility of the parties stipulated in Article 4, paragraph 1, and the involved parties shall bear the respective costs.

3. Delivery from Japan to the United States or the Republic of Singapore will be treated as checked baggage according to Article 11 (C) of JAL’s International Conditions of Carriage, and JAL’s responsibility is governed by the provisions of Article 18 of the same conditions.

4. During transportation, products are enclosed in polystyrene containers with -51°C refrigerants to maintain the surface temperature at about 5°C or lower, ensuring quality control.

5. The guaranteed refrigerated environment from packaging is as follows: The surface temperature of the product will be maintained at about 5°C or lower, with 24 hours for sliced meat and steak meat and 28 hours for block meat. Packaging time is noted on the outer box of the product. Quality and expiration dates of the product beyond the guaranteed refrigeration period or after exceeding the stated expiration date will not be guaranteed.


Article 9 (Receiving Method and Checked Baggage Flow)

(Departure from Japan / Arrival in the United States or the Republic of Singapore)

1. Users must come to the JAL ABC counter (departure lobby) at the departure airport 3 hours before the timetable departure time to 1 hour before. Users must check and receive the product themselves at the JAL ABC counter (departure lobby) with a photo ID. If users do not collect the product at least 1 hour before the scheduled departure time, no refunds will be given.

2. After checking and receiving the products, users must check them in as checked luggage at the departure check-in counter or automatic baggage deposit machine. Products cannot be carried on board. Any excess baggage charges due to the product deposit must be paid according to JAL’s regulations.

3. Purchased products will be returned as checked luggage at the arrival airport, so users must not forget to collect them. Uncollected products will be discarded without a refund.

4. Customs declaration may be required at the arrival airport. Users must proceed with the necessary customs declaration procedures in accordance with the arrival destination's laws on their own responsibility.

5. Sales packages include photos to indicate contents for users to check. The following certificates are included inside the package:


For the United States:

- Export Quarantine Certificate issued by the Animal Quarantine Service of the Ministry of Agriculture, Forestry and Fisheries of Japan.

- Meat Health Certificate issued by the Ministry of Health, Labour and Welfare of Japan.

- USDA document detailing conditions for travelers carrying personal consumption beef from Japan to the U.S.


For the Republic of Singapore:

- Export Quarantine Certificate issued by the Animal Quarantine Service of the Ministry of Agriculture, Forestry and Fisheries of Japan.


Export Quarantine Certificate

Issued in accordance with the Export Inspection Guidelines for Livestock Products set by the Animal Quarantine Service of the Ministry of Agriculture, Forestry, and Fisheries of Japan, following export quarantine inspections conducted by livestock quarantine officers at animal quarantine stations at departure airports.


Meat Health Certificate

Issued by facilities recognized as meeting the standards defined in the Handling Guidelines for Export Meat to the United States by the Ministry of Health, Labour and Welfare of Japan (as of December 26, 2023, there are 16 facilities nationwide). It is slaughtered, processed, packed, and sealed at these facilities, and the certificate is issued by inspectors designated by the Ministry of Health, Labour and Welfare.


USDA Document

Issued by the United States Department of Agriculture, indicating that travelers from Japan can import beef purchased as personal luggage into the United States if all conditions are met.


Article 10 (Post-Receiving Precautions)

1. After removing the product from the polystyrene container, promptly store it in a refrigerator maintained below 5°C. Quality deterioration after removal cannot be guaranteed.

2. Once the vacuum pack is opened, consume the product promptly. Storage by refreezing again cannot guarantee quality.

3. When cooking, thoroughly heat the product. Health impact from consuming undercooked meat cannot be guaranteed.


Article 11 (Cancellations, Refunds, Complaints)

1. If users cancel or change their scheduled flight for personal reasons after the purchase, they must notify JAL at least 48 hours before the scheduled departure time. Changes or cancellations due to user reasons are not possible after 48 hours before the scheduled departure time.

2. If the type, quality, or quantity of products does not conform to the sales contract content, users may request a full refund. Users must bring or mail the product to a location designated by JAL at the arrival destination.

3. If the scheduled flight is canceled, users must notify JAL of the change in the service use date at least 48 hours before the scheduled departure time. If the flight is canceled after 48 hours before the scheduled departure time and before the user receives the product at the JAL ABC counter (departure lobby), users may change the use date or request a full refund. If the flight is canceled after the user has received the product at the JAL ABC counter (departure lobby), the user must return the product to the JAL ABC counter (departure lobby). A full refund will be given.

4. If the scheduled flight is delayed and the arrival time exceeds the guaranteed refrigeration time, users may request a full refund. Users must bring or mail the product to a location designated by JAL at the arrival destination.

5. If the "WarmMark" included with the product turns red within the guaranteed refrigeration time, users may request a full refund. Users must bring or mail the product to a location designated by JAL at the arrival destination.

6. If the product cannot be loaded onto the scheduled flight, a full refund will be given.

7. Users must make all inquiries, complaints, and claims regarding products or JAL and the parties through the system of this EC shop. Communications to the parties by methods other than this will not be accepted.


Article 12 (Service Suspension, etc.)

1. JAL may temporarily suspend all or part of this Service without prior notice to users if any of the following apply:

(1) In case of failure, malfunction, or other reasons that make it impossible to provide this Service due to server, communication lines, or other equipment issues.

(2) For regular or emergency maintenance, inspection, repair, or changes to the system (including servers, communication lines, power supplies, and buildings that house them).

(3) In case service provision is impossible due to fire, power outage, etc.

(4) In case service provision is impossible due to natural disasters, such as earthquakes, eruptions, floods, tsunamis, etc.

(5) In case service provision is impossible due to war, disturbances, riots, chaos, labor disputes, pandemics, or other force majeure events.

(6) In case service provision is impossible due to laws or measures based on them.

(7) If JAL determines a temporary suspension is necessary for operational or technical reasons.

2. JAL may terminate or change all or part of this Service without prior notice to users at JAL’s convenience.

3. JAL assumes no responsibility whatsoever for any damages, whether direct or indirect, incurred by users or third parties as a result of suspension, termination, or change of this Service.


Article 13 (Ownership and Intellectual Property)

1. Ownership and intellectual property rights regarding this EC shop belong to JAL and its licensors, and users are not granted any intellectual property rights related to this EC shop.

2. Users shall not engage in any acts that might infringe the intellectual property rights of this EC shop (including but not limited to reverse engineering, reverse compiling, and reverse assembling).


Article 14 (Prohibited Acts)

The following acts are prohibited when using this Service:

1. Using content, including services and images provided by this Service, without permission.

2. Acts that harm the rights, interests, or honor of JAL, other users, or third parties.

3. Acts that interfere with the operation of this Service and may hinder service provision.

4. Ordering products without genuine intent to purchase.

5. Conducting transactions by impersonating others or inputting false information.

6. Fraudulent use of credit cards to access this Service.

7. Unauthorized access, tampering with information or programs, or sending or writing malicious computer programs to this EC shop.

8. Acts that violate laws or public order and morals.

9. Acts violating various JAL regulations and rules.

10. Purchase of age-restricted products, such as alcoholic beverages, by users under the age of 20.

11. Other acts deemed inappropriate by JAL.


Article 15 (Suspension/Cancellation of User Qualification)

1. If users violate the prohibited acts or these Terms, fail to perform obligations concerning transactions in this Service, or are suspected of doing so, JAL may take all or part of the following measures without notifying the user:

(1) Suspend the use of this Service by the user.

(2) Suspend the fulfillment of transactions such as product shipping.

(3) Request users to pay for the product by a means different from the method selected at the time of the order.

(4) Cancel privileges granted by campaigns, cancel unlawfully obtained benefits, and request users to return them.

2. JAL assumes no responsibility for any damages incurred by users due to the measures taken in the preceding paragraph.

3. If JAL or its contractors incur damages due to a user’s violation of the preceding articles, the user shall return any gains obtained from violations to JAL and compensate for damages incurred by JAL or its contractors immediately.


Article 16 (Compensation for Damages)

1. If users violate these Terms or cause damages to JAL or third parties in connection with the use of this Service, users shall compensate for such damages to JAL and third parties. Users assume all responsibility, including compensation liabilities to users and third parties who suffer damages due to such violations.

2. If JAL receives any claims from other users, producers, or third parties for infringement or other reasons in connection with the use of this Service, users shall compensate JAL for amounts paid to third parties based on such claims.

3. JAL shall not be liable for any compensation for damages incurred by users in connection with this Service unless there is intentional or gross negligence on JAL’s part.


Article 17 (Disclaimer)

1. JAL is exempt from liability for any damages incurred by users as a result of processing business related to this Service based on the user’s registered information.

2. JAL can change or abolish all or part of this Service without notice to users at its discretion, and JAL will not be liable for any damages incurred by users as a result.

3. JAL is not responsible for any damages incurred by users or third parties due to the provision, delay, change, interruption, suspension, cancellation, data leakage, or loss from this Service, except as separately stipulated.

4. JAL does not guarantee the authenticity, accuracy, timeliness, usefulness, reliability, legality, or non-infringement of third-party rights of any information provided free of charge on this site.

5. JAL’s liability to users in connection with the use of this Service is limited to actual and direct damages incurred, unless there is intentional or gross negligence on JAL’s part. JAL is not responsible for special damages caused by special circumstances, even if it could foresee or could have foreseen such damages.

6. JAL is not liable for damages incurred by users due to natural disasters, fires, earthquakes, floods, lightning, heavy snow, epidemics, wars, internal conflicts, terrorism, riots, labor disputes, enactment, revision, or abolition of laws and regulations, government interventions or orders, power outages, communication line or computer failures, system failures, system maintenance, unauthorized access, computer virus infections, data loss, transportation accidents, equipment accidents, or other force majeure events beyond JAL’s reasonable control.


Article 18 (Handling of Personal Information)

1. JAL handles user personal information in accordance with JAL’s separately defined privacy policy, and users agree to this.

2. Users agree to the provision of their personal information to JAL and the parties to the extent necessary for their use of this Service.


Article 19 (Governing Law and Jurisdiction)

The interpretation and application of these Terms and the use of this Service shall be governed by Japanese law unless otherwise stipulated. The Tokyo Summary Court or the Tokyo District Court shall have exclusive jurisdiction for the first instance for all disputes regarding the use of this Service.


Article 20 (Changes to Terms)

These Terms may be changed based on Article 548-4 of the Civil Code if JAL deems it necessary due to legal changes or other reasons. The fact that changes will be made, the contents of the changed provisions, and the effective time shall be given notice through a reasonable method, such as store display and homepage publication until the effective time arrives.
